Crime and Punishment of unfair search 120 of the Turkish Criminal Code.under Edit in the article has been taken. A public official who illegally searches someone’s top or belongings is considered to have committed the crime of wrongful search.

As can be understood, only public officials can commit the crime of unfair search. For this reason, the crime is a specific shit. In order for these people to constitute the crime of unfair search, they do not have such authority, that is, they must carry out the search action in violation of the law.

According to the related crime; a public official who searches for a person’s top or belongings in violation of the law is sentenced to imprisonment from 3 months to 1 year.

Damages caused by an immeasurable search of a person and confiscation of documents, information, documents or items, included that they could seek compensation if they suffered damage. The Supreme Court has decided to award material-moral compensation in favor of the plaintiff by overturning the Local Court’s decision to reject the claim for material-moral compensation due to unfair search.
