A recovery case is a case filed to determine who owns movable or immovable property whose ownership is disputed. The recovery case is an urgent case due to its structure. Therefore, it is subject to a simple trial procedure. The process begins with the fact that the persons claiming recoverys make these claims to the enforcement agency that performs the foreclosure process.

In order for the recovery case to be opened, a certain process must have taken place. As a result of the enforcement proceedings initiated by the creditor against the debtor, the payment order is finalized, as well as the items belonging to the debtor and the receivables contained in third parties are foreclosed by the bailiffs. During this process, it is possible to foreclose on items that are owned by a third party by considering the borrower’s belongings. If this happens, a claim for recoverys may be made by the debtor or a third party.
