What Are The Elements To Be Included In The Case Of Petition?

The lawsuits are brought to law courts and they are opened by petition. According to the Law of Civil Procedure No. 6100, there are some obligatory elements to be filed to file a lawsuit to sue. These mandatory elements are regulated in Article 119 of the Law on Civil Procedure No. 6100. According to the said provision;

The content of the case

ARTICLE 119- (1) In the petition the following matters shall be found:

a) The name of the court.

b) The name, surname and address of the claimant and the defendant.

c) The Republic of Turkey plaintiff’s identification number.

d) the name, surname and address of the legal representatives of the parties and the plaintiff’s representative, if any.

d) the value of the subject of the case in cases related to the subject and property rights of the case.

e) Open summaries of all cases under the sequence number of the claimant’s claim.

f) to prove by which evidence each alleged claim.

g) Legal reasons.

i) Clearly the result of the request.

h) The signature of the plaintiff, if any, of its legal representative or deputy.

(2) In the absence of the provisions of paragraphs (a), (d), (e), (f) and (g) of the first subparagraph, the judge shall give the plaintiff a final period of one week to complete the deficiency. In the event that the deficiency is not completed within this period, the case is considered unopened.
