Limited Property Right

Concept Of Rights In Kind:
As for the definition of the concept of rights in kind, theories that can be grouped into three groups
is available. According to those in the first group, which is the classical view, “the right in kind is the right that directly dominates something.” According to this view, the right in kind is considered a direct relationship between the property and its owner. Critics of this view have suggested that the legal relationship can only be established between individuals, stating that the legal relationship between a person and an item cannot be considered a legal subject, and the right in kind; ” on something that can be put forward against everyone they have defined it as” the right (which puts everyone in debt) ” (personal opinion) this view has also been criticized on the grounds that it is impossible to talk about the debt of all persons of the same nationality or foreigners in the face of a person’s property right. Proponents of this view have argued that the debt here belongs only to those who have contact with the right holder in kind, and its scope consists in not violating the property. Innovative theories that combine these two views are the right to the same; they defined it as” a right that gives a person direct control over something and therefore can be put forward against all.”
