16 May Is There a Legal Regulation To Protect The Worker Who is Insulted By His Employer ?
The regulation on this issue was introduced in Article 24/II-b of the Labor Law No. 4857. Accordingly, “ if the employer says words and acts in such a way as to touch the honor and honor of the employee or one of his family members”, he may immediately terminate the employment contract without notice of termination before or before the end of the term. As can be seen from the relevant part of the article, although these words were said against one of the members of the worker’s family, the worker
gives the right of termination. The employee, provided that in this case they also provide other conditions (work for at least one year, etc.) is also entitled to severance pay. In addition, the employee can also claim moral compensation for the fact that he has suffered an insult.
If the relevant words constitute a crime from the point of view of the Turkish Penal Code, the worker may also file a criminal complaint against the person/persons concerned.
