How Do Times Work In Law?
The documents sent to you by the court or the Enforcement Agency for payment, objection, response, litigation, etc.within a certain period of time may be prescribed. In the same way, a right-lowering or statute of limitations may be prescribed for the exercise of a right. These periods of 5-7-10-30 days, 2 Weeks, 1 month, 2 years, such as day, week, month, year are foreseen. So how will the periods be calculated in these cases?
In civil cases ” periods shall begin to operate from the date of notification to the parties or, in cases stipulated in the law, from the date of tefhim.
If the period is determined as a day, the day of notification or tefhim is not taken into account and the period ends at the holiday time of the last day.
If the period is determined as week, month or year, the day it starts ends at the holiday time of the corresponding day in the last week, month or year. If there is no day in the month that ends that corresponds to the day that it begins, the period ends on the last day of this month at holiday time.
Public holidays are included in the period only if the period is specified as working days, public holidays are not taken into account. If the last day of the period coincides with the bank holiday, the first working day following the period holiday ends at the end of the working hour.”
