Family Residence Permit In Turkey
Family residence permits are issued in Articles 34 to 37 of the foreigners and International Protection Law No. 6458. In addition, family residence permits are regulated in articles 30 to 34 of the regulation on the application of the foreigners and international protection law.
Who Are The Foreigners Who Can Be Granted A Family Residence Permit?
Turkish citizens, those under Article 28 of Law No. 5901, or foreigners with one of the residence permits, refugees and holders of secondary protection status;
A) the foreign spouse,
b) to the child of a foreigner who is not an adult of his or her spouse,
C) he or her dependent foreign child,
family residence permit can be arranged.
If the foreigner requesting a family residence permit has more than one spouse, only one of the spouses can be granted a family residence permit. However, all children of the foreigner may be granted a family residence permit.
If the children are outside our country, they should have the consent of the parents who have joint custody.
The family residence permit provides the right for students to study in primary and secondary institutions until the age of eighteen without obtaining a residence permit.
How Many Years Can A Family Residence Permit Be Arranged?
– Family residence permit can be arranged not to exceed three years at a time.
– The duration of the family residence permit cannot exceed the duration of the sponsor’s residence permit in any way.
What Are The Requirements Of A Family Residence Permit?
In order for the family residence permit to be issued, foreigners must bear the requirements of Article 35 of the law.
– Meet the requirements sought in the promoter,
(Sponsor’s valid health insurance that covers the whole family, have a monthly income of no less than a third of minimum wage per capita, in the last five years has committed a crime against Family order that criminal records documentation to reside in Turkey less than a year and be registered in the address registration system)
– To meet the requirements for family residence permit applicants to stay with the promoter,
(To present supporting information and documents for the purpose of staying in our country, to reveal that he or she is living with the specified persons, to have reached the age of eighteen of the spouses, to not fall within the scope of Article 7 of the mentioned law, marriage is not done for the purpose of obtaining a family residence permit)
What are the reasons why the family residence permit is not refused, cancelled or extended?
– Failure to meet or disappear the requirements for family residence permit,
– Determining that the family residence permit is used outside the purpose of granting,
– A valid deportation or prohibition of entry into the country.,
in case the family residence permit is not granted, if it is granted, it is cancelled and those whose term has expired are not extended.
