Extension Of Lease Agreements Subject To General Provisions
The characteristic of fixed term lease agreements subject to General Provisions is that they expire at the end of the said period. However, the lessor must file an eviction suit within one month from the end of this period or follow up with the eviction request due to the end of the period.
However, in certain term contracts, if the lessor has made a notice that the contract will not be extended before the end of the term, the contract in question cannot be extended and after the end of the term, the lessor may sue for eviction at any time.
If there is no agreement between the parties in the lease agreement that the contract will not be extended explicitly,then the lease agreement for the fixed term becomes an indefinite term lease if the lessee continues to take up the lease and the lessor continues to take up the lease.(that is, the beginning becomes a lease agreement with a certain period of time).
In contracts of indefinite duration, a lawsuit is filed in accordance with the termination notice periods in order to sue.
If there is a notice clause in the contract that the lease agreement will be extended, and the parties have not complied with this notice clause, the contract shall extend as long as the period in the contract on the same terms.
Extension of contracts on rent of residential and roofed workplaces
The situation is slightly different in residential and roofed workplace rents. In fixed term lease agreements, if the tenant does not give notice that he will terminate the contract 15 days before the end of the contract, the contract will be extended one year on the same terms.
