DORMITORY USAGE AGREEMENT BETWEEN STUDENT AND PRIVATE STUDENT DORMITORY

ARTICLE 1 -) PARTIES:

A dormitory Substitution Agreement has been concluded between the parties whose names and addresses are mentioned above with the following conditions. Henceforth in the contract, providing services (dormitory), student receiving services…….he is also named only as (student).

ARTICLE 2 -) PURPOSE OF THE CONTRACT:

The purpose of this agreement is to define the definition, conditions, content and dormitory fee of the dormitory service provided in the Private …Higher Education sorority, to define the conditions for the student to receive this service, the responsibility of the dormitory and the student.

ARTICLE 3 -) GENERAL PROVISIONS:

3.1. At the time of signing this agreement, the parent of the minor student will sign the agreement on behalf of the student and will be originally responsible for the fulfillment of the agreement.[1]

3.2. The parties have accepted all the provisions written in this agreement of their own free will and have mutually accepted responsibility and rights in accordance with these provisions.[2]

3.3. The dormitory accepts students within the framework of the regulation on private student dormitories of the Ministry of National Education and the instructions of the dormitory.[3]

3.7. If the student wants to stay in the dormitory outside of the education period, a fee will be charged separately.

3.8. If the student does not pay on the appointed day, his deposit will not be returned and he will be dismissed from the dormitory.

3.10. The student and his parent are mutually responsible for the payment of the dormitory fee.[7]

ARTICLE 4 -) OBLIGATIONS OF THE DORMITORY ADMINISTRATION: [8]

4.1. The dorm is obliged to house its student and provide him with his meals.

4.2. The dormitory management is responsible for the general cleaning of the rooms and common areas in the dormitory.

4.3. The dorm is obliged to provide its students with hot water between the hours.

4.4. The dormitory is responsible for preparing and presenting the meals given in the dormitory in hygienic conditions.

4.5. The dormitory is obliged to ensure that the student can meet with his or her visitors comfortably.

4.6. The dormitory administration is responsible for ensuring the safety of the student within the dormitory.

ARTICLE 5 -) OBLIGATIONS OF THE STUDENT:

5.1. The student is obliged to avoid behavior that would threaten the order, peace and security of the dormitory.

5.2. A student cannot stay anywhere but in the room allocated to him by the dorm.

5.3. The student is obliged to compensate for the damage caused to the fixtures in the common areas and/or room within the country.

5.4. The student is obliged to keep the rooms and common areas belonging to the dormitory regular and clean.

5.5. A student cannot use cigarettes, alcohol, drugs both in the country and in his room.

5.6. Banners on the walls, doors and/or windows of the student room under no circumstances-pictures, etc. shall not exceed.

5.7. A student cannot walk around the hostel in inappropriate clothes, such as pajamas and nightgowns, except in his room.

5.7. He cannot accommodate guests from outside in the Student Room, and he cannot allow boarding. He can meet his guests from outside in the area that the hostel will show.

5.8. He will provide himself with materials such as beds, quilts, sheets that he will use in the student’s room.

5.9. When the student is not in the room, he must put his personal and valuable belongings in his locker. The dormitory cannot be held responsible for the theft/loss of items that are not locked in the closet.

5.10. The student is obliged to observe the meal hours and the entrance and exit hours of the dormitory.

5.11. If the student wants to stay outside the dormitory on weekdays and/or weekends, he / she is obliged to bring a permit from his / her family and give it to the dormitory management.

5.12. A student cannot bring a boyfriend to or around the dorm.

5.13. In no case can the student make political-divisive propaganda and grouping in the country.

5.14. After the student has completed his / her work in the study hall, he / she will not leave the course tools and equipment on the tables and will not own the tables.

ARTICLE 6 -) OBLIGATIONS OF THE STUDENT’S PARENT:

6.1. By ensuring that the student complies with the rules of the dorm, not challenging the sanctions imposed in the face of the student’s behavior that violates the dorm agreement.

6.2. Ensure that the student shows the necessary sensitivity regarding the payment of dormitory fees.

ARTICLE 7 -) PENALTIES AND RESPONSIBILITIES OF THE PARTIES :

7.1. If the above-mentioned responsibilities are not fulfilled, the provisions of the special student dormitories regulation will be applied, and the student will not object to the application in any way and will accept the action to be taken against it.

ARTICLE DURATION OF CONTRACT :

8.1. This agreement is valid between the opening and closing dates of the faculties and does not cover the completion period.

ARTICLE 9 -) STATE OF DISPUTE:

9.1. In the event of disputes that may arise from this agreement, the Executive Offices and courts are authorized.[10]

ARTICLE 10 -) CONCLUSION:

10.1. Business this agreement consists of 10 (ten) articles, including this article ../../ … has been edited in two copies and signed by the parties and a sample has been given to the student / parent.

[1] minors and restricted persons with the power to distinguish cannot fall into debt through their own transactions unless they have the consent of their legal representatives (4721 P. K. m. 16).

[2] the contract is established by the parties ‘ mutual and consistent explanations of their will (6098 P. K. m. 1)

[3] the following documents are requested for registration and admission of students to dormitories:

a) application petition,

b) identification number of the Republic of Turkey,

c) a document indicating that the student continues his / her education and a health report indicating that his / her health status is favorable for his / her stay in the dormitory and organized by a single doctor,

d) Two passport photos,

e) declaration of the judicial record of those who have reached the age of 18, to be confirmed later by the dormitory administration (regulation on private student dormitories m. 16).

[4] dormitory fees are charged in advance or in installments as specified in the contract. The fees to be charged are detailed in the contracts concluded at the time of Registration (Regulation on private student dormitories m. 17).

[5] receiving a deposit, provided that the terms of the contract are specified, depends on the request of the hostel operator. The deposit cannot exceed one month’s fee. Deposits are refunded by the amount of a monthly dorm fee on the date of their return (regulation on private student dormitories m.17).

[6] dormitory fees are paid monthly, in advance or according to the principles specified in the contract. Promissory notes can be received in exchange for term payments. According to the principles of the contract, students who do not pay dormitory fees can be deducted from their deposits if they have one. If the relationship with the dormitory is terminated, the provisions of the contract are complied with (regulation on private student dormitories m.18).

[7] if each of the multiple debtors informs the creditor that he has agreed to be responsible for the entire debt, fiduciary indebtedness arises (6098 P. K. m. 162).

[8] the tasks of Belletters are:

a) to take care of the education of the students staying in the dormitory during the study hours,

b) guiding students in dining halls and dormitories to ensure that they eat and sleep regularly,

c) ensure timely and regular performance of laundry and bath work,

d) conducting surveys,

e) inform administrators of the status of sick students,

f) timely notification of the situation to the director of the dormitory in important disciplinary events,

d) perform other tasks that the director will give (regulation of private student dormitories m.30)

[9] disciplinary provisions apply to students who do not comply with the written considerations in this regulation, do not comply with the prohibitions and provisions of its convention, engage in attitudes and behaviors that are not appropriate for students at home and abroad (regulation on private student dormitories m.32).

[10] cases arising from the contract may also be filed in the court of the place where the contract will be executed (6100 P. K. m. 10).
