INSTRUCTIONS :
1-My client …. In …. Dekar has signed a contract with the defendant to buy a cotton harvester for cotton cultivation. (Annex 1) however, our client has suffered damage because the harvester he received from the defendant has been constantly malfunctioning and therefore has been taken to the technical service at various times and has not been able to use it for a long time. (Appendix 2)
2-according to Article …… of this agreement; payments will be made by cheque. As can be seen from the accompanying current account statement (Annex 3), our client has regularly made payments on the dates set out in the contract in accordance with the liability.
3 – however, the defendant’s side business has not fulfilled its responsibilities under this contract, in order to fulfill the acts subject to the contract by us …/…/… on the date …. Notary public…. although the notice was withdrawn with the notice of Duty (Annex 4), no concrete steps were taken to carry out the acts from the defendant.
4-in light of the issues explained above, the business has been obliged to open this case.
