08 Aug Apartment Dues

III-participation in general expenses of Anagayrimenkul :
Article 20 – (amended first paragraph: 13/4/1983-2814/9 md.) Unless there is any other agreement between each of the floor owners:
The expenses of the janitor, the radiator, the gardener and the caretaker, and the advance collected for them are equal to;
The company is obliged to participate in the insurance premiums of the company and other expenses such as maintenance, protection, retrofitting and repair expenses of all common places and the manager’s pension, as well as the operating expenses of the common facilities and the advance to be collected for expenses at the rate of its land share.
Floor owners cannot avoid paying this expense and advance share by giving up the right to use them on common places or facilities or by suggesting that there is no need or need to benefit from them due to the situation of their own independent department.
The floor owner who does not pay the expense or advance share can be sued by each of the other floor owners or the manager in accordance with the management plan, this law and general provisions, and execution follow-up can be carried out.
The floor owner, who does not pay the full amount of the expense and advance share, is obliged to pay the delay compensation with a monthly five percent account for the days that he is delayed in the payment.
If the expenses in the first paragraph were caused by a flawed act of one of the floor owners or the person benefiting from its independent section in any way, those who participated in the expense had recourse to that floor owner or those who caused the expense for their payments.
