23 Jan Expropriation
Property rights can only be limited if there is a public interest. In such limitation transactions, the value of the real estate is determined first, and then the determined real estate price is paid to the owner of the real estate. After that, the registration of the real estate in question passes to the administration. Expropriation operations are carried out in two types, normal expropriation and emergency expropriation.
In the Normal expropriation process, all legal actions of the real estate to be expropriated are carried out before the real estate is transferred to the administration. In some cases, all legal proceedings except the determination of the value of the real estate begin after the real estate has passed into administration. This, in turn, refers to urgent expropriation operations. In this case, it is mostly carried out by the General Directorate of land roads.
It should be noted that only state institutions can perform nationalization. Here, the unit that will make nationalization must first make a decision in the public interest. A public interest decision taken after that is approved by the relevant authority. Thus, the nationalization process begins.
The administration, which will carry out the expropriation, prepares a plan showing the face measurement and limit of the real estate and finds the owners of the real estate that it will expropriate through the land registry and population records and notifies the relevant people of the decision.
