The case concerns the request for issuance of an inheritance certificate.

\nMiras\u00e7\u0131l\u0131k istemi, 6100 Say\u0131l\u0131 HMK\u2019n\u0131n ge\u00e7ici 3\/2. maddesi ve HMK\u2019n\u0131n 382. maddesinde \u00e7eki\u015fmesiz yarg\u0131 i\u015flerinden say\u0131lm\u0131\u015f 384. maddede ise kanunda aksine h\u00fck\u00fcm bulunmad\u0131k\u00e7a, \u00e7eki\u015fmesiz yarg\u0131 i\u015fleri i\u00e7in talepte bulunan ki\u015finin veya ilgililerden birinin oturdu\u011fu yer mahkemesi yetkili oldu\u011fu, HMK\u2019n\u0131n 11\/3. maddesinde ise miras\u00e7\u0131l\u0131k belgesinin iptali ve yeni miras\u00e7\u0131l\u0131k belgesi verilmesine dair davalarda miras\u00e7\u0131lar\u0131n her birinin oturdu\u011fu yer mahkemesinin de yetkili oldu\u011fu belirtilmi\u015ftir. Bu hale g\u00f6re, miras\u00e7\u0131l\u0131k belgesinin verilmesi davalar\u0131nda kesin yetki kural\u0131 olmad\u0131\u011f\u0131na g\u00f6re davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 ilk mahkeme olan \u0130zmir 10. Sulh Hukuk Mahkemesinde g\u00f6r\u00fcl\u00fcp sonu\u00e7land\u0131r\u0131lmas\u0131 gerekir.<\/p>\n
SONU\u00c7 : Yukar\u0131da belirtilen nedenlerle; 6100 Say\u0131l\u0131 HMK\u2019n\u0131n 21 ve 22. maddeleri gere\u011fince \u0130zmir 10. Sulh Hukuk Mahkemesi\u2019nin yarg\u0131 yeri olarak belirlenmesine 15\/01\/2018 g\u00fcn\u00fcnde oy birli\u011fiyle karar verildi.<\/p>\n
