id=\"gt-text-top\">\n<div id=\"gt-res-c\" class=\"g-unit\">\n<div id=\"gt-res-p\">\n<div id=\"gt-res-data\">\n<div id=\"gt-res-wrap\">\n<div id=\"gt-res-content\">\n<div dir=\"ltr\"><\/div>\n<div id=\"gt-res-dir-ctr\" class=\"trans-verified-button-small\" dir=\"ltr\"><span id=\"result_box\" lang=\"en\"><span title=\"Yasaklanm\u0131\u015f Haklar\u0131n Geri Verilmesi \u015eartlar\u0131\n\n\">Conditions for the Return of Prohibited Rights<\/p>\n<p><\/span><span title=\"5352 say\u0131l\u0131 Adli Sicil Kanununa eklenen 13\/A maddesi gere\u011fi yasaklanm\u0131\u015f haklar\u0131n iadesi isteminde bulunabilmek i\u00e7in \u00fc\u00e7 \u015fart\u0131n bir arada bulunmas\u0131 zorunludur:\n\n\">In accordance with Article 13 \/ A of Law No. 5352 on the registration of prohibited rights under Article 13 \/ A, it is compulsory to have three conditions:<\/p>\n<p><\/span><span title=\"1-Yasaklanm\u0131\u015f haklar\u0131n iadesi i\u00e7in ilk \u015fart, mahkum olunan cezan\u0131n infaz edilmesidir.\">1-The first condition for the restitution of prohibited rights is the execution of the convicted sentence. <\/span><span title=\"Cezan\u0131n infaz edilmesinden kastedilen h\u00fck\u00fcml\u00fcn\u00fcn cezaevinden ko\u015fullu sal\u0131verilerek tahliye edilmesi de\u011fildir.\">The imposition of the sentence does not mean that the convict is released from the prison by conditional release. <\/span><span title=\"Ko\u015fullu sal\u0131verilen h\u00fck\u00fcml\u00fcn\u00fcn d\u0131\u015far\u0131daki denetim s\u00fcresini de tamamlayarak ceza mahkemesinin mahkumiyet h\u00fckm\u00fcnde yer alan t\u00fcm ceza s\u00fcresinin infaz edilmesidir.\">It is also the execution of the whole period of the criminal court&#8217;s conviction by completing the period of external supervision of the convicted released convict. <\/span><span title=\"\u00d6rne\u011fin, h\u00fck\u00fcml\u00fc ceza mahkemesinin karar\u0131yla 8 y\u0131l ceza alm\u0131\u015f ise 6 y\u0131l cezaevinde yatt\u0131ktan sonra ko\u015fullu sal\u0131verilirse geriye kalan 2 y\u0131ll\u0131k s\u00fcreyi de d\u0131\u015far\u0131da ge\u00e7irdikten sonra cezas\u0131 infaz edilmi\u015f olur.\">For example, if the convict has been punished for 8 years by a criminal court ruling and 6 years after being released in prison, he \/ she will be executed if the remaining 2 years are spent outside. <\/span><span title=\"Cezas\u0131 infaz edilen h\u00fck\u00fcml\u00fc yasaklanm\u0131\u015f haklar\u0131n geri verilmesi isteminde bulunabilir.\n\n\">The convicted prisoner may request the return of prohibited rights.<\/p>\n<p><\/span><span title=\"2-Yasaklanm\u0131\u015f haklar\u0131n iadesi i\u00e7in ikinci ko\u015ful, cezas\u0131n\u0131n infaz\u0131ndan itibaren 3 y\u0131ll\u0131k bir s\u00fcrenin ge\u00e7mi\u015f olmas\u0131d\u0131r.\">2-The second condition for the return of prohibited rights is that a period of 3 years has passed since the execution of the sentence. <\/span><span title=\"Cezan\u0131n infaz\u0131ndan itibaren 3 y\u0131l ge\u00e7memi\u015fse hi\u00e7bir \u015fekilde yasaklanm\u0131\u015f haklar\u0131n geri verilmesi isteminde bulunulamaz.\n\n\">If no more than three years have elapsed since the execution of the sentence, it is forbidden to demand that the prohibited rights be returned.<\/p>\n<p><\/span><span title=\"3-Yasaklanm\u0131\u015f haklar\u0131n iadesi i\u00e7in \u00fc\u00e7\u00fcnc\u00fc ko\u015ful, cezan\u0131n infaz\u0131ndan ba\u015flamak ve cezan\u0131n infaz\u0131ndan sonra ge\u00e7irilmesi gereken 3 y\u0131ll\u0131k s\u00fcre de dahil olmak \u00fczere bu s\u00fcre i\u00e7erisinde h\u00fck\u00fcml\u00fcn\u00fcn yeni bir su\u00e7 i\u015flememesi ve ya\u015fam\u0131n\u0131  \u201ciyi halli\u201d olarak s\u00fcrd\u00fcrd\u00fc\u011f\u00fcne dair mahkemede kanaat olu\u015fturmas\u0131d\u0131r.\">3-The third condition for extradition of prohibited rights is that the convicts do not commit a new offense during this period, including the 3-year period of execution of the sentence and the conviction in the court that he \/ she continues to live in a ve good condition 3. <\/span><span title=\"Uygulamada competent court to request the return of prohibited rights. <\/span><span title=\"Yasaklanm\u0131\u015f haklar\u0131n geri verilmesine dair talepler bir ceza avukat\u0131 veya herhangi bir avukat vas\u0131tas\u0131yla da mahkemeye sunulabilir.\">Requests for restitution of prohibited rights may be submitted to the court through a criminal lawyer or any lawyer.<\/span><\/span><\/div>\n<div dir=\"ltr\">\n<div id=\"gt-c\" class=\"g-section\">\n<div id=\"gt-form-c\">\n<div id=\"gt-text-all\">\n<div id=\"gt-main\">\n<div id=\"gt-text-c\">\n<div id=\"gt-text-top\">\n<div id=\"gt-res-c\" class=\"g-unit\">\n<div id=\"gt-res-p\">\n<div id=\"gt-res-data\">\n<div id=\"gt-res-wrap\">\n<div id=\"gt-res-content\">\n<div dir=\"ltr\"><\/div>\n<div id=\"gt-res-dir-ctr\" class=\"trans-verified-button-small\" dir=\"ltr\"><span id=\"result_box\" lang=\"en\"><span title=\"Yasaklanm\u0131\u015f Haklar\u0131n \u0130adesi Karar\u0131 \u0130\u00e7in Yetkili Mahkeme\n\n\">Jurisdiction for the Restitution of Prohibited Rights<\/p>\n<p><\/span><span title=\"Yasaklanm\u0131\u015f haklar\u0131n geri verilmesi karar\u0131 verme konusunda yetkili iki mahkeme mevcuttur:\n\n\">There are two jurisdictions authorized to decide on the return of prohibited rights:<\/p>\n<p><\/span><span title=\"1-Yasaklanm\u0131\u015f haklar\u0131n iadesi karar\u0131, h\u00fck\u00fcml\u00fcn\u00fcn yarg\u0131land\u0131\u011f\u0131 mahkeme taraf\u0131ndan verilebilir.\">1-The decision to extradite prohibited rights may be granted by the court where the convict is tried. <\/span><span title=\"H\u00fckm\u00fc veren mahkeme, mahkumiyet h\u00fckm\u00fcn\u00fcn i\u00e7eri\u011fine daha kolay ula\u015fabildi\u011fi i\u00e7in yasaklanm\u0131\u015f haklar\u0131n iadesi istemi i\u00e7in en uygun mahkeme as\u0131l h\u00fckm\u00fc veren mahkemedir.\n\n\">The court, which gives the court the most appropriate court for the request for the extradition of the prohibited rights, is the court which gives more easily the content of the conviction.<\/p>\n<p><\/span><span title=\"2-H\u00fck\u00fcml\u00fc, h\u00fckm\u00fc veren mahkeme d\u0131\u015f\u0131nda bir isteminde bulunabilir.\">2-If the convict has been resident in a place other than the court, the convict may apply to a court with the same court as his \/ her conviction. <\/span><span title=\"\u00d6rne\u011fin, Antalya 1.
