(Additional sentence: 24\/11 \/ 2016-6763 \/ 41 art.) However, against the decisions made in the case of non-pecuniary damages, appeal may be made regardless of the amount or value. (one)<br \/>\n(3) In case a part of the claim is sued, the limit of three thousand Turkish Lira is determined according to the total amount of the receivable. (one)<br \/>\n(4) In case the claim has been filed, the party which does not exceed the three thousand Turkish Liras of the original claim may not apply to the appeal. (one)<br \/>\n(5) The first instance courts may be appealed to other laws or may be appealed to the Court of Appeals.<\/p>\n<p>Appeals that cannot be appealed<br \/>\nItem No: 362<br \/>\n(1) No appeal may be lodged on the following decisions of the regional courts of appeal:<br \/>\na) Decisions on cases where the amount or value does not exceed forty thousand Turkish Liras (including this amount). (one)<br \/>\nb) Decisions related to the cases referred to in Article 4 (except for the cases related to the same as the immovable property arising from the Law on Floor Ownership dated 23\/6\/1965 and no.<br \/>\nc) Decisions on resolving authority and duty disputes between the first instance courts within the jurisdiction.<br \/>\n\u00e7) Decisions made in contentious jurisdictions.<br \/>\nd) Decisions related to the cases related to the correction of the population records, except for cases that give rise to the results of the genealogy.<br \/>\n(e) Decisions on the transfer of the case to another court within the jurisdiction where the judges of the first instance courts in the judiciary environment appear to have legal or actual obstacles to see the case.<br \/>\nf) Decisions on temporary legal protection.<br \/>\n(2) In the case of a part of the claim in the paragraphs (a) of the first paragraph, if the claim is filed, the limit of certainty of forty thousand Turkish Liras shall be determined according to the total receivable. In the case that the entire claim has been filed, the party which does not exceed the forty thousand Turkish Liras of the original claim is not entitled to appeal. However, if the other party makes an appeal, the other party may appeal the decision. (one)<\/p>\n<div id=\"gt-c\" class=\"g-section\">\n<div id=\"gt-form-c\">\n<form id=\"gt-form\" action=\"\/\" enctype=\"application\/x-www-form-urlencoded\" method=\"get\" name=\"text_form\">\n<div id=\"gt-text-all\">\n<div id=\"gt-main\">\n<div id=\"gt-text-c\">\n<div id=\"gt-text-top\">\n<div id=\"gt-res-c\" class=\"g-unit\">\n<div id=\"gt-res-p\">\n<div id=\"gt-res-data\">\n<div id=\"gt-res-wrap\">\n<div id=\"gt-res-content\">\n<div id=\"gt-res-dir-ctr\" class=\"trans-verified-button-small\" dir=\"ltr\"><span id=\"result_box\" lang=\"en\"><span title=\"GE\u00c7\u0130C\u0130 MADDE 3 \u2013 (Ek: 31\/3\/2011-6217\/30 md.)\n\">PROVISIONAL ARTICLE 3 &#8211; (Annex: 31\/3 \/ 2011-6217 \/ 30 art.)<br \/>\n<\/span><span title=\"(1) B\u00f6lge adliye mahkemelerinin, 26\/9\/2004 tarihli ve 5235 say\u0131l\u0131 Adli Yarg\u0131 \u0130lk Derece Mahkemeleri ile B\u00f6lge Adliye Mahkemelerinin Kurulu\u015f, G\u00f6rev ve Yetkileri Hakk\u0131nda Kanunun ge\u00e7ici 2 nci maddesi uyar\u0131nca Resm\u00ee Gazete'de ilan edilecek g\u00f6reve ba\u015flama tarihine kadar, 1086 say\u0131l\u0131\">(1) According to the provisional article 2 of the Law on the Establishment, Duties and Powers of the Judicial Courts of First Instance No. 5235 and the Law on the Establishment, Duties and Powers of the Judicial Courts of the Regional Courts, dated 26\/9\/2004, no. 1086 <\/span><span title=\"Kanunun temyize ili\u015fkin y\u00fcr\u00fcrl\u00fckteki h\u00fck\u00fcmlerinin uygulanmas\u0131na devam olunur.\n\">The applicable provisions of the law on appeal shall continue to be enforced.<br \/>\n<\/span><span title=\"(2) B\u00f6lge adliye mahkemelerinin g\u00f6reve ba\u015flama tarihinden \u00f6nce aleyhine temyiz yoluna ba\u015fvurulmu\u015f olan kararlar hakk\u0131nda, kesinle\u015finceye kadar 1086 say\u0131l\u0131 Kanunun 26\/9\/2004 tarihli ve 5236 say\u0131l\u0131 Kanunla yap\u0131lan de\u011fi\u015fiklikten \u00f6nceki 427 il\u00e2 454 \u00fcnc\u00fc madde h\u00fck\u00fcmlerinin uygulanmas\u0131na devam olunur.\n\">(2) The implementation of the provisions of Articles 427 to 454 of 26\/9\/2004 and the Law no. 5236 of the Law no. 1086 on the decisions made before the date of commencement of the judicial courts are finalized.<br \/>\n<\/span><span title=\"(3) Bu Kanunda b\u00f6lge adliye mahkemelerine g\u00f6rev verilen hallerde bu mahkemelerin g\u00f6reve ba\u015flama tarihine kadar 1086 say\u0131l\u0131 Kanunun bu Kanuna ayk\u0131r\u0131 olmayan h\u00fck\u00fcmleri uygulan\u0131r.\n\n\">(3) In cases where the regional courts of justice are assigned in this Law, the provisions of Law no.<\/p>\n<p><\/span><span title=\"Parasal s\u0131n\u0131rlar\u0131n art\u0131r\u0131lmas\u0131\n\">Increasing monetary limits<br \/>\n<\/span><span title=\"Madde No: EK MADDE 1\n\">Article No: ANNEX ARTICLE 1<br \/>\n<\/span><span title=\"(Ek: 24\/11\/2016-6763\/44 md.)(1) 200 \u00fcnc\u00fc, 201 inci, 341 inci, 362 nci ve 369 uncu maddelerdeki parasal s\u0131n\u0131rlar her takvim y\u0131l\u0131 ba\u015f\u0131ndan ge\u00e7erli olmak \u00fczere, \u00f6nceki y\u0131lda uygulanan parasal s\u0131n\u0131rlar\u0131n;\">(Annex: 24\/11 \/ 2016-6763 \/ 44 art.)
