14 Apr WHAT IS THE APARTMENT FEE?
The legal provisions related to apartment dues are contained in the articles within the scope of the Condominium Ownership Law. What does the Apartment dues cover in the following articles of the law?; How much is the apartment fee?; How and where is the apartment dues determined?
III – Participation in the general expenses of the parent school :
Article 20 – (Amended first paragraph: 13/4/1983 – 2814/9 art.) Unless each of the deckholders has an agreement of some other kind between them:
Equal to the expenses of the janitor, heater, gardener and caretaker and the advance that will be collected for them;
Anagayrimenkul is obliged to participate in insurance premiums and other expenses such as maintenance, protection, strengthening and repair expenses of all common dec, as well as the administrator’s pension, as well as operating expenses of common facilities and the advance payment to be collected for expenses at the rate of its own land share.
Floor owners cannot refrain from paying this share of expenses and advances by giving up the right to use it on common places or facilities or by claiming that there is no need and need to use them due to the status of their own independent department.
A flat owner who does not pay his share of expenses or advances can be sued by each of the other flat owners or the manager in accordance with the management plan, this Law and the general provisions, and enforcement proceedings can be conducted.
The floor owner who does not pay the full share of expenses and advances is obliged to pay delay compensation with a five percent monthly account for the days when he is late in payment.
If the expenses in the first paragraph were caused by a defective act of one of the floor owners or a person who benefited from its independent part in any way, those who participated in the expense had the right to recourse to that floor owner or those who caused the expense for the payments they made
