WHAT DOES PROBATION MEAN?
The law is a criminal law institution that allows the execution of a person’s sentence in public life during the specified trial period. The person who committed the crime is observed through probation in public life.
The probation law is a law that was issued on the grounds that a person can maintain ties with his family and adapt to the outside world. When the convict is serving his sentence in prison, he is released after a certain period of conditional release and is kept under supervision in public life outside.
DURATION OF PROBATION
the period of probation for crimes committed before 01.07.2016 was 2 years, and for crimes committed after this date, the period of probation was one year. With the probation arrangement to be made now, a person will be able to spend the rest of his/her time on probation after spending 1/5 of the total sentence he/she has received in the penal house, and the probation period will be limited to 3 years. In other words, probation will be increased to 3 years.
If we give an example of this situation,;
If a person who has received a 4-year sentence has been placed on a repetition clause, he can serve 3 years, 58. Mad. if not, he will spend 2 years and 8 months in a prison. But with the probation law, repeat offenders will be able to spend about 216 days of their sentence, and non-repeat offenders will be able to leave on probation after spending 192 days in prison.
