The rule of good faith and honesty
A confusion that is often encountered in practice has also left its mark on this issue: subjective wishful thinking, that is, objective wishful thinking with good intentions, that is, honesty, is often confused. the regulation on them in MK No. 4721 is as follows:

“I. Acting honestly/ Article 2 – Everyone must follow the rules of honesty when exercising their rights and fulfilling their debts./ Flagrant abuse of a right
law does not protect order.

II. Good faith/ Article 3- In cases where the law binds a legal conclusion to good faith, the main thing is the existence of good faith./ However, no one who does not take the care expected of him according to the requirements of the situation can claim good faith”.
