SANCTIONS FOR ACTIONS CONTRARY TO THE LAW ON THE PROTECTION OF PERSONAL DATA:
Crimes:
135 to 140 of the Turkish Criminal Code No. 5237 in terms of crimes related to personal data. the provisions of the article shall apply. 7 Of the Act. in violation of the provisions of Article 138 of the Law No. 5237; those who do not delete or anonymize personal data. it is punishable by article.
Misdemeanors:
18 of the law entitled “misdemeanors”. According to the article;
a) 10.from 5,000 Turkish liras to 100,000 Turkish liras about those who do not fulfill the lighting obligation stipulated in the article,
b) from 15,000 Turkish liras to 1,000,000 Turkish liras about those who do not fulfill the obligations related to data security provided for in Article 12,
c) from 25,000 to 1,000 Turkish liras for those who do not fulfill the decisions made by the Board in accordance with Article 15 to 1,000,000 Turkish liras,
d) From 20.000 Turkish liras to 1.000.000 Turkish liras about those who act contrary to the obligation to register and notify the Data Officers Register provided for in Article 16,
an administrative fine is imposed. Administrative fines provided for in this article are applied to natural persons who are responsible for data, as well as legal entities of private law.
(3) of the actions mentioned in the first paragraph if it is committed within public institutions and public professional organizations, the board will, upon notification, the relevant public institutions and organizations and other public officers who served in the disciplinary provisions are processed according to those who served in public with professional organisations and the results reported to the board.
