LEGAL CONSEQUENCES OF CONCILIATION AT THE STAGE OF PROSECUTION

– If a settlement occurs, the court decides to drop the case if the defendant def’at performs his act as a result of the settlement.

– If the performance of the act is left for a later date, connected in a taxi or requires continuity; without any conditions, it is decided to leave the disclosure of the provision undone. The statute of limitations does not apply during the withdrawal period.

– After the decision is made to withdraw the disclosure of the provision, if the requirements of the settlement are met, the case is decided to be dropped by eliminating the provision that was left undisclosed.

– After a decision is made to withdraw the disclosure of the provision, if the requirements of the settlement are not met, the provision is announced by the court without any conditions.

– If the defendant does not fulfill his/her performance, the reconciliation report shall be deemed to be one of the documents written in Article 38 of the Law No. 2004.
