06 Dec IS THERE A LEGAL REGULATION TO PROTECT THE EMPLOYEE WHO HAS BEEN INSULTED BY THE EMPLOYER?
Regulation on the subject 4857 p. It is introduced in Article 24/II-b of the Labor Code. According to this;
“ If the employer utters words and acts in a way that touches the honor of the employee or one of his family members, ” he may terminate it immediately without notice of termination before or before the expiration of the employment contract. As can be seen from the relevant part of the article, although the words in question were said against one of the members of the employee’s family, the employee
gives the right of termination. The worker must also provide for other conditions in this case(at least one year of work, etc.) he is also entitled to severance pay. In addition, the employee may also file a claim for non-pecuniary damages due to the defamation act he has suffered. If the related words constitute a crime from the point of view of the Turkish Criminal Code, the employee may also file a criminal complaint against the person/persons concerned.
