If The Entire Highway is Destroyed, Its Ownership In Real Estate Ends

II-destruction of the Constitution:

Article 47-if the entire highway is demolished, condominium ownership on the real estate ends alone.

If one of the independent parts of the Constitution is completely destroyed and the maliki of that section does not rebuild its section within two years, other floor owners or some of them may ask the judge to transfer the share of the land belonging to that section to them within one year, starting from the completion of this period, in exchange for its value and in the proportion of land shares. In this case, the shares of the transferred land are referred to the House of the relevant pages (declarations) of the condominium log; land share takers, starting from the date of takeover, within two years, the ruined independent section to be rebuilt or within the same period, all flat owners are obliged to re-harvest the land shares related to independent sections in accordance with the principles of Article 3, Paragraph 2 of this law to transfer to the condominium register.

If the above provision of the paragraph is not complied with, the condominium on anagayrimenkul ends on its own, and the provisions of common ownership apply to the insurance price received for both this real estate and the ruined sections.

If one of them is completely ruined and connected to other independent owners, if more than one independent section is rebuilt, it is obliged to notify the other owners in writing within six months of the date of Ruin, which again destroys them and is usually destroyed. (Amended sentence RGT: 28.11.2007 RG NO: 26714 law no: 5711/20) (Code 1) it is assumed that those who do not report do not want to rebuild, and their land shares are primarily transferred to those who want to rebuild their parts in exchange for their value.

Condominium on the independent sections of the Ruin is automatically converted to a floor easement when the periods written in this article continue, and a temporary comment is given to the House of declarations in the condominium log. When the independent section is made, the condominium on it is reborn and the temporary comment is deleted from the log.
