Extension of Lease Agreements
Extension of Lease Agreements Subject to General Provisions
The peculiarity of fixed-term lease agreements subject to the general provisions is that they expire at the end of this period. However, the lessor must file for eviction within one month from the end of this period or follow up with an eviction request due to the expiration of the period.
However, if the lessor has made a warning that the contract will not be extended before the expiration of the period in certain term contracts, this contract will not be extended and the lessor can always file for eviction after the expiration of the period.
If a notice has not been taken and there is no agreement between the parties in the lease agreement that the contract will not be extended explicitly, the fixed-term lease agreement turns into an indefinite-term lease agreement if the tenant continues to be a tenant and the lessor continues to receive dec.(that is, it becomes a lease agreement, the beginning of which is unclear for a certain period of time).
For filing a lawsuit on indefinite-term contracts, a lawsuit is filed in accordance with the notice periods for termination.
If there is a notice requirement in the contract that the lease agreement will be extended and the parties have not complied with this notice requirement, the contract will be extended for the same terms as the period in the contract.
Extension of Contracts for the Rent of Residential and Roofed Workplaces
The situation is slightly different in residential and roofed workplace rents. For fixed-term lease agreements, if the lessee does not give notice that he will terminate the contract 15 days before the end of the contract, the contract will be extended for one year under the same conditions.
However, it is not possible for residential and roofed workplace rents to become indefinite with the expiration date of the contract.
It is possible to rent it indefinitely in places subject to workplace rents with residential roofs.
Extension of Product Lease Contracts
As we mentioned above, a fixed-term lease agreement expires at the end of the period. The lessor must file for eviction within one month from the end of the period or follow up the eviction request due to the end of the period.
Again, in certain term contracts mentioned, the contract cannot be extended if the lessor has discovered a warning that the contract will not be extended before the end of the period.after the end of the period, the lessor can always open his case
If there is no agreement between the parties that the contract will not be extended unless a warning has been dec, the fixed-term lease agreement will be extended for one year under the same conditions if the tenant continues to be a tenant and the lessor continues to receive rent.
In order to file a lawsuit in the extended period, a lawsuit is filed in accordance with the notice periods for termination.
If there is a notice requirement in the contract that the lease agreement will be extended and the parties have not complied with this notice requirement, the contract will be extended for the same terms as the period in the contract.
