Confiscation of traffic accidents and expert testimony

Article 83 – traffic accidents;

a) local general police to be made in accordance with the judicial direction,

b) by determining the causes, traces and evidence of the accident, the traffic accident detection report is confiscated by the traffic police.

In accidents occurring on highways where the traffic police is not on duty or is not present, the traffic accident detection report is organized by the local general police and a sample is sent to the traffic police of that place.

In case of agreement of the parties and if the Act does not constitute another crime, judicial prosecution shall not be carried out and the provision of Article 565 of the Turkish Criminal Code shall not be applied in traffic accidents that occur on highways and result only in property damage.

In cases where the road is closed to traffic in traffic accidents, the traffic police or general police are authorized to open the highway to traffic after marking the tracks and evidence so as not to disappear and taking the necessary actions.

If it is understood that the prosecutor of the Republic will be delayed if the road is closed to traffic, the road will be opened to traffic after the necessary markings are made and the vehicle and the dead are set aside and the situation is determined by a record.

If the traffic police is assigned according to the procedural laws, it acts as an expert in traffic accidents.
