21 Sep A PETITION FOR REQUESTING THE RELEASE OF THE DEFENDANT
TO THE CHAIRMAN OF THE SUPREME CRIMINAL COURT
Base Number:
WHO WANTS TO BE RELEASED/DEFENDANT:
ATTORNEY:
PROSECUTOR:
CRIME: Establishing a criminal organization, becoming a member of the organization, dealing drugs within the framework of the organization’s activity.
CRIMINAL HISTORY: …/…/…
SUBJECT: It includes a request to decide on the release of the accused.
INSTRUCTIONS
For the following reasons, we request that the decision be made to release the accused;
1-Despite the fact that he found out that an arrest warrant had been issued against him during the investigation phase conducted for the crime subject to the case, the defendant voluntarily surrendered. This shows that he has no intention of escaping because of his behavior and that he intends to find the place of justice.
2-The defendant has a certain place of work and address of residence. The certificate of headship that we present in the addition also proves the address of residence. In the same way, my client works in the traffic monitoring business in the city where he lives, and if he continues to be detained, his environment will decrease and he will have difficulty in his work will lead to distress. His own surrender is also a guarantee that he will not escape.
3-All the evidence from the file was collected and the witnesses and other defendants were listened to. And there is no evidence that can be gathered against him. We also state that we will present evidence in its favor at the trial stage.
4-The accused has no relations and connections with any organization. As we can see, when we examine the file, we can see that making a few phone calls does not mean membership in the organization, it is not fair to see. In other words, there is a high probability that the accusation against you will change.
CONCLUSION: For the reasons mentioned above, we demand that the defendant be released without security or with the necessary security and atonement. …/…/…
ADDITION 1-Certificate of residence from the headman.
2-SSK certificate that the defendant is working.
