19 Feb THE CASE OF TROVER AND ITS CONSEQUENCES
The court in charge of the trover case is the First Instance Law Courts. The competent court, on the other hand, is the court of the defendant’s place of residence or the court of the place where the enforcement proceedings are conducted.
If the case is won by the plaintiff in the trovercase, not only the money paid to the creditor by enforcement proceedings, but also the enforcement fees and expenses that he has to pay, the defendant has the right to receive from the creditor.
It should be noted that if the payment is made regardless of the fact that the debt has expired, an trover case cannot be filed for the return of the money paid by the borrower.
On the other hand, if the plaintiff loses the case, the defendant will have to pay the creditor the costs of the trial related to the case.
In the cases explained, it is also out of the question that the party who lost the case will be sentenced to pay 40% compensation.
